The updated version of these Terms and Conditions will be effective immediately, at the same time it is published on this website.

These Terms and Conditions will always be available on this website, so that the User and/or Customer can consult them at all times.

The service provision contract may be formalized, at your choice, in any of the languages in which the Terms and Conditions are available on this website, but the English wording will prevail in case of discrepancy between the different versions.

The Company is not affiliated, enforced, operated or owned by the U.S Health Department State Office and/or governmental entity. This website is not a U.S State Department website.

The Company is not a law firm and, therefore, does not provide legal advice or representation. No attorney-client relationship is formed by using the Services offered herein. The Services and information offered on this Website do not constitute legal advice and are in no way a substitute for a licensed attorney or specialized law firm. Therefore, if you believe you need it, we recommend that you consult with a licensed attorney.

Our Services

We provide private professional assistance services related to obtaining copies of vital records issued by the U.S Health Department States Offices (the “Services”).

Remarks:

  • Please be advised that state laws only permit the issuance of a certified copy of a vital record to a person with a direct and tangible interest in the record. For that reason, the Company can carry out actions to verify that the applicant meets this condition.
  • Applicants requesting records shall furnish adequate identifying information to ensure the correct record is released.
  • Vital records are for personal use only and not for commercial exploitation.

This Website offers the following Services:

A. Standard Service

This Service includes:

  • Obtain a customized electronic form (PDF format) for requesting an original certified copy of a vital record, which can be downloaded to send to the U.S Health Department State Office where your vital record was issued.
  • Obtain personalized instructions on how to submit the vital record application form before the U.S Health Department State Office.
  • 24/7 multilingual Customer Service to assist you and solve doubts that may arise with filling out the vital record application form and reviewing the accuracy and completeness of the information provided by the Customer to ensure the form meets the U.S Health Department State Office’s requirements. In this regard, please be informed that Customer Service’s agents may contact you to confirm information or request additional details in order to provide you with a correct application form.

Remarks:

  • Customers have to print their vital record application form on their own and present it before the U.S Health Department State Office.
  • The certified copy of the vital certificate requested is issued by the U.S Health Department State Office where your vital record was issued, once the Customer submits the application and it is approved by said Department. In this regard, please note that:
    • Approval or denial, and in any case the issuing of a vital record application is an exclusive competence of the U.S Health Department State Office.
    • The processing time of your application remains in the hands of the U.S Health Department State Office. Please check the State Fees & Processing Times page of this Website to consult the standard processing time of the State of your interest.

B. Premium Service

This Service is only available for requesting copies of birth certificates.

This Service includes:

  • Submitting, on behalf of the Customer, an application for obtaining an original certified copy of a birth certificate before the U.S Health Department State Office which is the competent body that issues the certified copy of the vital record of your interest. In this regard, please note that:
    • The approval or denial of a vital record application is an exclusive competence of the specific U.S Health Department State Office the birth certificate has been requested form.
    • The U.S Health Department State Office may request additional information or need to confirm information during the review process of your application. In that event, We will let you know about the information requested by the Government.
    • The processing time of your application remains in the hands of the U.S Health Department State Office. Please check the State Fees & Processing Times page of this Website to consult the standard processing time of the State of your interest.
  • The U.S Health Department State Office will send you the certified copy of the vital record requested by post. In this regard, you will have the opportunity to choose between standard or express shipping, before proceeding to the payment page of the total cost of this Service.
  • 24/7 multilingual Customer Service that submits the Customer’s birth certificate application, after reviewing the application form he/she has completed in order to ensure the accuracy and completeness of the information provided by the Customer and to ensure the form meets the U.S Health State Office’s requirements. Also, the Customer will be updated regarding the application’s status. In this regard, please be informed that Customer Service’s agents may contact the Customer to check the information provided or to request additional details before submitting his/her vital record application.

This Service may have the following add-ons:

  • Extra copies: before proceeding to the payment page of this Service, Customers will have the option to indicate if they would like to obtain - for an extra charge - various copies of the birth certificate of their interest.
  • Express delivery: this is a service offered by most of the U.S Health Department State Offices. By paying an extra charge, the State Office will send the certified copy of the birth certificate requested via private courier service so that the applicant can receive it faster. Before proceeding to the payment page of this Service, Customers will have the option to indicate if they would like to hire the express delivery service.

The “extra copies” and “express delivery” add-ons may have different costs depending on the U.S State from which the issuance of the copy of the birth certificate is requested. Said costs will be shown before the payment page of the Premium Service. If the Customer selects any of these add-ons, its costs will be added to the Premium Service price.

Remarks:

  • This Service grants to the Customer access to a private profile/area, where he can check the status of the request process for a copy of their vital record as well as other information that the Customer must provide so that our Customer Service can complete the application process, such as an “Identity Verification Form” (required by the competent authorities of some US states) which the Customer must mandatorily download, complete and sign and then upload it to the private profile/area.
  • The credentials for accessing the private profile/area will be sent by the Company to the Customer via email.
  • All Customers that purchase the Premium Service, will have to mandatorily download, complete and sign an Identity Verification Form and then upload it to the private profile/area in order We can fishin the application process.
  • If you select the Premium Service, you grant us your consent to:
    • communicate your personal data to third party service providers to complete the process of requesting your vital certificate copy. This communication is necessary only in those cases that the U.S Health Department State Office establishes that requests for copies of vital certificates must be submitted through its ordering agents. We will only disclose your personal data and/or private information to those ordering agents authorized by governmental vital records Offices; and also,
    • act as your "designated representative"/"agent", being necessary that the applicant expressly authorizes the Company to submit his/her vital record application on his/her behalf. The Company will not be able to process your application and therefore provide the Services without the applicant’s authorization (bear in mind that applicant must be a person with a direct and tangible interest in the record, as stated above).

If you do not agree and/or do not meet the above statements/requirements, please refrain from hiring our Services.

You can consult our Privacy Policy for further information regarding how we process and protect your personal data and private information.

C. Priority Service

For both services - Standard and Premium - we offer a Priority Service for a fee:

  • For Standard: you will receive your vital record application form with preference over other application forms from other customers.
  • For Premium: we will submit your vital record application on your behalf with preference over others customers.

Customers will have the option to select the Priority Service on the payment page of the Standard or Premium Service selected.

Please check the Costs and Exemption from Responsibility sections of these Terms and Conditions in connection with this section.

Hiring our Services

Requirements for hiring our services:

  • You must be an adult and have legal capacity to enter into contracts, according to the applicable national laws and regulations of your birth and/or residence country. Minors are excluded from using the Services. We reserve the right to carry out the verifications it deems appropriate to verify this fact, adopting the corresponding due diligence measures in accordance with current applicable legislation.
  • If the Services are purchased for a minor, you must be their parent and/or legal guardian. We reserve the right to carry out verifications deemed appropriate to verify this fact, adopting the corresponding due diligence measures in accordance with current applicable legislation.
  • You (and/or the applicant) must be a person with a direct and tangible interest in the record (e.g: immediate family members, legal guardian, official representatives, etc).
  • Applicants must provide personal data and/or private information that is truthful, accurate, completed and updated, on the vital record application form selected. Otherwise, the U.S Health Department State Office may not approve the vital record application. Our Customer Service can be contacted for the rectification of inaccurate personal data provided in the application form; by email: info@birthorderrecord.com or through our Contact Form.

Steps to request our Services:

Step 1: Choose and fill out the vital record application form of your interest and accept the present Terms and Conditions.

  • Please be informed that you are only required to provide the personal data and information strictly required by the corresponding U.S Health Department State Office in order to submit a copy of the vital certificate.
  • Please note that we do not have the authority to issue the vital certificate and, therefore, we cannot offer any guarantee regarding the application process, since the evaluation and outcome of the application (approval or denial) rests with the competent agency: the Office of the U.S. State Department of Health.

Step 2: Select between Standard Service and Premium Service. (See “Our services” section, for detailed information about the Services offered).

Step 3: If you select the Premium Service, you must choose between standard or express postal delivery for receiving the certified copy of your vital record.

Please be informed that:

  • The shipping costs may vary depending on each U.S. State.
  • Some U.S States may only have one shipping method (standard or express).

Step 4: Accept the present Terms and Conditions and select your preferred payment method (Please see the Costs section of these Terms and Conditions, for further information regarding the costs of the Services).

Please be informed that:

  • The acceptance of the present Terms and Conditions is an express and clear declaration by the User that they have read it and understands that they will be automatically bound to them when confirming the payment of the selected Service.
  • The confirmation of payment for the selected Service also confers the status of Customer.

Starting our assistance services

Remarks:

  • By entering your payment information and confirming the payment of the costs of the selected Service (i) you confirm your willingness to purchase our private assistance services and (ii) you acknowledge you have been informed and agree with the costs of the Service selected.
  • The selected Service Standard Service or Premium Service will only be provided once the payment of the costs has been authorized and confirmed.
    • If the payment of the selected Service is not confirmed, We reserve the right to terminate the contractual relationship with you and not to process your request to provide our assistance services.
    • The Customer has six (6) months to enjoy our assistance services, after which period, if not used, the Customer will not have the right to claim the provision of the Services. In this regard, please check the section “Cancellation of Services by the Company” section of these Terms and Conditions.
  • You will receive a payment confirmation email of the selected Service with your order number/application reference number.
    • Please note this number may be required by our Customer Service in order to correctly address your request(s) regarding the selected Service (See “Customer Service” section of these Terms and Conditions).
    • At this point, the services provision contract is considered formalized and these Terms and Conditions enter into force and are binding on you and the Company.

Costs

Our private assistance services have the following costs:

A. Standard Service

A one-off payment for a total of $59.

Notes:

  • Our private fee for this Service does not include the fee charged by the U.S State Health Department for assessing a vital record application form.
  • You can consult the State Fees & Processing Times page of this Website to consult the public/State fees applicable to the vital record form of your interest.
  • The Customer will have to pay the applicable State fee to their vital record application at the time of submitting it at the U.S State Health Department Office.
  • The total cost of this Service will be shown on the payment page.

B. Premium Service

A lump-sum payment of the total charges which will depend on the options you have selected.

Notes:

  • The total cost of this Service may vary depending on the U.S State you have selected to submit your vital record application. The cost of this Service includes our private fees and the fee charged by the U.S Health Department State Office for assessing a vital record application form.
  • To the total cost of this Service will be added the cost of:
    • the number of copies ordered of your vital record certificate.
    • the shipment (standard or express) you have selected
  • You can consult the State Fees & Processing Times page of this Website to consult the public/State fees applicable to the vital record form of your interest.
  • The payment page will show an itemized summary of the total costs of this Service, depending on the options selected by you.

Remarks for Standard Service and Premium Service:

  • If you decide to make an upgrade, once already purchased the Standard Service, and contract the Premium Service, you will have to bear just the difference of the price between these services.
  • Our private service fees may change from time-to-time due to business strategy, objectives or needs. The new private service fee will be effective immediately, at the same time it is published on this website, not being necessary prior notice to Users and/or Customers. However, the new private service fee is not retroactive and it will not affect Customers who have already purchased our Services before the change.
  • Likewise, please note that each U.S State Health Department Office can also modify its public fees at any time, being a circumstance beyond our reasonable control.
  • The Company and the Customer shall bear their own bank commissions/rates. We shall not be responsible for any foreign exchange fees and/or surcharges imposed by the Customer’s entity bank or card issuer for the transaction (payment of the costs of the Selected service) and will not provide any compensation or refund for such circumstances.
  • We reserve the right to sometimes make special offers and/or discounts on the price of our Services. The User will benefit from the offer and/or discount only if they expressly accept the promotion notice. Please note that said special offers could be subject to specific conditions and cannot be added to other offers.
  • All special offers and/or discounts will be marked as such on the screen. If they are not marked as such, the company will not assume any responsibility in case of obvious errors. We recommend that you read the particular conditions of the offers and/or discounts before accepting the promotion notice and/or confirm the payment of our service package.
  • We reserve the right to suspend, either temporarily or permanently, the offers and/or discounts and/or modify their conditions, extend the period of validity of them and/or immediately exclude users from these advantages, at our discretion, for any reason and without prior notice to Users and/or Customers. However, these modifications will not be retroactive and, therefore, will not affect the offers / discounts already acquired by Users and/or Customers.

C. Priority Service

The fee for this Service will be shown on the payment page and it will be:

  • The Priority Service fee will be added to the total cost of the Standard service or Premium service and its ancillary services.
  • The Priority Service fee may change from time-to-time due to business strategy, objectives or needs.

Payments

You may use different methods of payment to purchase our Services. The payment methods we accept are indicated on our website and/or the payment page of the Services.

Do not attempt to make a payment in a way other than those specified on our website. If you do, we will not be liable for loss of payment or any other damages that may arise from this action.

By confirming the payment of the costs of the selected Service you acknowledge and confirm that:

  • You have been informed and agree with the costs of the selected Service.
  • The debit/credit card used for the payment is yours or you are the legitimate holder. Therefore, the Company will not assume any responsibility in case you are not the holder or legitimate holder of the card, since this circumstance is beyond our reasonable control. However, if necessary, the Company will provide appropriate cooperation to the Customer and/or law enforcement and/or judicial authorities, for the detection and/or investigation of fraudulent operation(s) linked to the debit or credit card used to make payment of the Services.

Please be informed that:

  • As a general rule, the payment transaction will be reflected on your bank statement with the Merchant ID "VITALFORM". This identifier may vary based on different factors (e.g: business reasons, services purchased, origin and destination of the transaction, method of payment, etc).
  • If your debit/credit card has been blocked/declined/expired, we will be unable to process the payment of the selected Service and, therefore, it will not be provided. For any financial problems you might be experiencing, please contact your bank.
  • Credit cards may be subjected to checks and authorizations by the issuing bank. If said entity does not authorize the intended payment, the selected Service will not be provided. We will not assume any type of responsibility for lack of provision and/or delays in the provision of the Service selected due to delays in approving the planned charge and/or denial of the transaction.

The costs of our private assistance services may be charged, indistinctly, by the following Merchant(s) of Record:

The Merchant of Record is Blue Korp Op Services LLC, a company with TAX ID number 87-3720594, inscribed in the Mercantile Registry of Houston and registered Office at 1880 S Dairy Ashford rd, Suite 207, Houston, TX 77077 and contact email info@birthorderrecord.com (hereinafter, “the Merchant’s identification”).

The Merchant of Record is Lened Internet Services LLC, a company with TAX ID number 32-0556912, inscribed in the Mercantile Registry of Hollywood and registered Office at 2430N 61st av Hollywood, FL 33024 and contact email info@birthorderrecord.com (hereinafter, “the Merchant’s identification”).

The Merchant of Record is Vital Records Direct SL, a company with TAX ID number B67006890, inscribed in the Mercantile Registry of Barcelona, in volume 45925, section 101, sheet 503166, registration 1, and registered Office at Avenida del Litoral, 12-14, 5 08005 - Barcelona and contact email info@birthorderrecord.com (hereinafter, “the Merchant’s identification”).

All Merchants of Record will make and manage the collection of the total costs of the Services offered through the present website and, where appropriate, refunds made and/or requested by the Customer:

  • In your bank statement and/or requested invoices, you will see the Merchant of Record identification.
  • Please see the "Refund Policy" section of the present Terms and Conditions for further information.

All Merchants of Record will also issue the invoice for the charges made, when required by the Customer to the Customer Service. The Customer expressly authorizes the Merchant of Record to send the invoice in an electronic format, although you can also indicate to our Customer Service your desire to receive a paper invoice, in which case we will send it in this format to the postal address that you indicate to us.

All Merchants of Record have put in place the maximum measures to ensure the reliability and security of communications and interactions between the Users and/or Customers and this website in a completely secure manner. In this regard, please note that the payment card data is transmitted directly through a secure connection to the information systems of our payment service provider(s). Therefore, we do not have access to or store your complete payment card data.

Technical means for correcting errors

Prior to paying the total costs of the selected Service, you will have the opportunity to review all the personal information and details provided on your vital record application form and make changes if necessary. If you have made an error, it is important that you correct it before proceeding. Once you have confirmed the form is correct and complete, you will be directed to the payment page for the selected Service.

Likewise, if you detect an error in the charges made by the Merchant of Records on your bank statement you can contact our Customer Service, by email info@birthorderrecord.com or through this Contact Form, to request information on the charge made and, when appropriate, the situation will be regularized.

Withdrawal Right and Cancellation

In accordance with the exceptions established by the currently applicable laws and regulations, being the vital record application form a clearly personalized document, as it contains your personal data and information as applicant, you cannot exercise the right of withdrawal as it is not applicable.

Moreover, if you have selected the Premium Service and your vital record application has already been submitted to your U.S Health Department State Office, it is not possible to cancel the application process since the Service is considered to be rendered.

Cancellation of services by the Company

The Company reserves the right to cancel the provision of the Standard Service and/or Premium Service, if the applicant (customer) commits (by way of example) any of the acts described below:

  • Not completing the payment of the Services;
  • Leaving the vital record application form without completing it within 180 days;
  • Omitting or failing to provide further information and/or documents required during the application process (e.g proof of family relationships);
  • Failing to provide the applicant’s consent/authorization to act as his/her "designated representative/agent” to submit the vital record application on his/her behalf.
  • Failing to comply with any of our instructions regarding the vital record application process;
  • Not replying to our emails requesting additional information required by the U.S Health Department State Office to asses the vital record application;
  • Willingly providing fraudulent, erroneous, incomplete and/or inaccurate information;
  • Breaching any part of these Terms and Conditions and, in general, any behavior of the User/Customer in pursuit of a fraudulent or unlawful purpose.

As for the reasons above, the Customer will be informed of the cancellation of the Service in writing; not being able to claim the provisions of the Services to the Company.

Remarks:

  • For the Premium Service, the Customer will be required to complete and sign an “Identity Verification Form” which must be uploaded to the Customer’s private profile/area in our Website. If the Customer fails to provide us with “Identity Verification Form” within fifteen (15) days from the date the Company informs the customer (applicant), via email, that the form is available in the private profile/ area and it must be filled, We reserve the right to cancel the provision of our assistance services.
    Only in certain cases and subject to the Company's sole discretion, “Identity Verification Forms” uploaded after the deadline indicated by the Company will be admitted and our assistance services will be provided. Please note that, processing the “Identity Verification Form” out of time, it may result in costs to the Customer.
    In this regard, please be informed that, if We cancel our services for the reason above, the Customer cannot claim the provision of the assistance services for their vital record application from the Company, nor request any type of compensation.

Exemption from Responsibility

In accordance with the provisions of Our Services and Hiring our Services sections of the present Terms and Conditions, the Company (nor any of its Officers, directors and employees) will not assume any responsibility for the following circumstances that are beyond our reasonable control, such as:

  • The Customer is not an adult nor has the legal capacity to contract the Services offered through this website in accordance with the laws and regulations of his/her birth or residence country or State. The Company will not assume any responsibility for access to this website by Users under the required legal age according to their country’s applicable laws and regulations, this being the sole responsibility of their parents and/or legal guardians to exercise adequate control over the activity and/or use of the Internet by their dependent minors; nor for preventing their access to websites whose content is not suitable or recommended for minors, or the sending of personal data without the prior authorization of their parents or legal guardians.
  • Both in the case of the Standard Service and the Premium Service, if the Customer has not fulfilled the vital record application form with accurate, truthful, complete and updated personal data and/or private information, the Customer shall be solely responsible for any inaccuracy or falsity of the information provided as well as for the outcome (approval or denial) of their vital record application, and the Company shall not be held liable for any consequences or damages that may arise as a consequence thereof.
  • If the Customer has not complied with the requirements of the U.S. Department of Health State Office during the application process (e.g: failing to provide proof of family relationships).
  • If the applicant is not a person with a direct and tangible interest in the record (e.g: immediate family members, legal guardian, official representatives, etc). In this sense, the Company will not be liable if a legitimate applicant is impersonating another legitimate applicant in the vital record application process. The Company's responsibility is limited to offer assistance services to submit a vital record application.
  • It is beyond the Company and the Company has no liability for disagreements or conflicts that exist and/or may arise between two legitimate applicants for a vital certificate. Legitimate applicants must resolve their disagreements by the means they deem appropriate, without involving the Company. In no case will the legitimacy of the Company's Services be questioned, due to such disagreements.
  • In the case of the Premium Service, the Company shall not be liable if the Services cannot be provided for lack of consent/authorization from the applicant to allow Us to act on his/her behalf to submit his/her vital record application.
  • In the case of the Premium Service, if the Customer does not provide the “Identity Verification Form” required to complete the application process.
  • If you have purchased the Standard Service, whether or not the Customer has submitted the vital record application form before the corresponding U.S State Health Department State Office.
  • Both in the case of the Standard Service and the Premium Service, the time it takes for the U.S State Health Department Office to approve or deny a vital record application and/or issuing the certified copy of the record, as it is an exclusive competence of the government. In this regard, the maximum that the Company can do is keep you informed of the status of the procedure, in the event that you have purchased the Premium Service.
  • Both in the case of the Standard Service and the Premium Service if the US Health Department State Office does not explain the reasons why it has rejected a vital record application.
  • The Customer has fulfilled the vital record application form with personal data of an adult third party and provides it to us with their due express consent. In such a case, the Company will inform the interested person how their personal data and/or private information has been collected and, where appropriate, we will ask the individual who provided the personal data to the Company to confirm they requested the consent of the data subject and, where appropriate, to amend this situation.
  • The Customer has fulfilled the vital record application form with a minor’s personal data, without being their parent or legal guardian.
  • The Customer contracted the Services offered through this website under the belief that the Company provides legal services/advice.
  • The vital record application forms available in this website are provided on an “as is” basis, without establishing express or implicit guarantees of any kind, express or implied. If the User and/or Customer thinks the forms do not fit their necessities and/or situation, we strongly encourage him/her to consult a lawyer or a specialized law firm.

The Company will not provide refund or financial compensation to the Users and/or Customers for any of the above reasons.

For the purposes of the present Terms and Conditions, specially regarding this section, “Customer” is understood as the individual who has paid for the selected Service.

Refund Policy

By accepting our Terms and Conditions and entering payment information, the customers clearly declare that they agree to the price of the Services offered through this website. The price is displayed on the checkout page and recalled in the payment confirmation email sent to customers.

Notwithstanding the foregoing, a refund must be requested within a maximum of 120 natural days since the date of the payment confirmation email. After this period of time, no refund requests will be approved, except in particular cases, depending on the circumstances of the customer.

To request a refund, for security reasons, the Customer Service shall be provided with the following information: (i) the same personal data provided in the vital record application form completed and (ii) the order code / application reference number they received with the payment confirmation email. If the customer has made multiple vital record applications, each refund request needs to be filled in individually.

If the refund request is submitted within the indicated period and in compliance with the above conditions, the amount that will be refunded is as follows:

  • If the customer has purchased the Standard Service, they will be considered eligible for a full refund of our services fees.
  • If the customer has purchased the Premium Service and their vital record application HAS NOT BEEN SUBMITTED to the U.S Health Department State Office, they will be considered eligible for a full refund of all charges made.
  • If the customer has purchased the Premium Service and their vital record application HAS ALREADY BEEN SUBMITTED to the U.S Health Department State Office, but they HAVE NOT PROVIDED THE IDENTITY VERIFICATION FORM, they will be considered eligible for a full refund of all charges made.
  • If the customer has purchased the Premium Service and their vital record application HAS ALREADY BEEN SUBMITTED to the U.S Health Department State Office and HAS PROVIDED THE IDENTITY VERIFICATION FORM, they will be considered eligible only for a full refund of our service fees.
    • Not in all vital record application processes and/or US states, the U.S Health Department State Office fees are refundable.
    • Only in particular cases, depending on the circumstances of the customer, we will consider whether or not to assume the fee charged by the Government.

If a refund request is approved, the reimbursement will be made to the same payment method that you used to pay the Services. A confirmation email will be sent to the customer as soon as the refund has been issued. Depending on the customer’s bank, the refund process can take up to ten (10) business days from the confirmation e-mail to be completed.

Remarks:

  • We reserve the right to refuse refund requests that do not meet the above conditions.
  • If the Company has canceled the provision of the assistance services for Customer’s vital record application because the Customer has not returned the “Identity Verification Form” duly signed and the Customer requests a refund, the costs of generating this document will be deducted from the amount to be reimbursed.
  • Requesting a refund through your bank does not guarantee the return of the charges made for the Services and is a slower process than contacting our Customer Service. Bear in mind that the customer should provide their bank a valid reason for what they claim your money back. Our Company carefully reviews refund requests through bank entities and those requests considered as fraudulent are reported to the competent authorities, together with all customer data associated with the transaction, in compliance with our legal obligations and legitimate defense of our interests and rights.
  • If the customer detects an undue or unacknowledged charge in connection with our services on the card used to purchase them, please contact our Customer Service, so we can provide assistance, as well as take the corresponding steps that the Company deems appropriate.

Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws and regulations currently applicable in Spain and the United States.

In the case of controversy or disagreement between the Customer and the Company arising from these Terms and Conditions, both parties agree to submit their case, at their free will and expressly waiving any other jurisdiction to which they may be entitled, to the competent Courts and Tribunals of the customer’s place of residence.

The non-exercise by the Company of any right provided or derived from these Terms and Conditions shall not be construed, under any circumstances, as a waiver of said right, unless expressly and in writing renounced by the Company or by the legal prescription of the action, according to the applicable current law or regulation.

The nullity, total or partial, of any of the provisions of these Terms and Conditions, will not affect the validity of the other provisions.
